Terms and Conditions | Magnetic Funding Source
Website use and service terms

Terms and Conditions

These Terms govern your use of Magnetic Funding Source, including the guided review for business funding, self-employed mortgage inquiries, and loan broker or funding-partner opportunities. They also explain our role, the role of independent partners, and the limits of information provided through this website.

Please read these Terms before using the website or submitting information. Magnetic Funding Source is not a lender and does not make credit decisions. A website submission is a request for review or information; it is not an approval, commitment to lend, mortgage approval, employment offer, franchise, business-opportunity agreement, or promise of compensation. A separate partner agreement, disclosure, application, or contract will govern any actual product, service, broker relationship, referral arrangement, or transaction.

1

Acceptance of these Terms

By accessing, browsing, or using magneticfundingsource.com, submitting a form, or communicating with us through the website, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the website or submit information.

These Terms apply only to your use of the Magnetic Funding Source website and related communications. They do not replace the terms, privacy notices, disclosures, applications, or contracts of an independent lender, mortgage provider, broker network, referral partner, service provider, or other third party.

2

Eligibility and authority

You must be at least 18 years old and have legal capacity to use the guided review or submit an inquiry. If you submit information for a business or another person, you represent that you are authorized to do so and that you have all necessary permission to provide the information.

The website is primarily intended for users in the United States. Products, services, mortgage programs, broker opportunities, and partner relationships may not be available in every state or jurisdiction. Accessing the website from a location where a pathway is unavailable does not create eligibility or a right to receive it.

3

Website purpose and guided pathways

Magnetic Funding Source provides a guided entry point that helps visitors identify the type of request that may fit their situation and route information for possible follow-up. The current pathways are:

Business FundingFor business owners exploring working capital, equipment, expansion, inventory, payroll, real estate, cash-flow support, or another business-purpose need.
Self-Employed MortgageFor self-employed individuals exploring a property purchase, refinance, investment property, commercial property, or another mortgage-related inquiry.
Loan Broker or Funding PartnerFor people exploring a broker, referral, lead-introduction, or funding-partner relationship through an independent network or partner.
General InquiryFor questions, website support, or follow-up concerning an existing submission.

Selecting a pathway is only an indication of interest. It does not determine eligibility, approval, licensing status, compensation, assignment, product availability, or the outcome of any review.

4

Our role and independent partners

Magnetic Funding Source is a marketing, lead-generation, information-routing, and connection resource. We are not a lender and do not make credit decisions. Unless expressly disclosed otherwise in a separate written agreement, we do not originate, underwrite, approve, fund, service, or collect payments on loans or mortgages.

We may route information to independent funding sources, mortgage providers, brokers, broker networks, referral organizations, technology vendors, or service partners. These parties are separate businesses. They control their own eligibility standards, underwriting, licensing, disclosures, documentation, communications, fees, approvals, denials, product terms, and service decisions.

No agency relationship: A website link, logo, photograph, public association, partner reference, or form integration does not by itself create an agency, joint venture, fiduciary, employment, franchise, or exclusive relationship between Magnetic Funding Source and any third party.
5

No approval, funding, rate, or earnings guarantees

Nothing on this website is a preapproval, credit decision, commitment to lend, mortgage approval, rate lock, term sheet, offer of credit, securities offer, employment offer, franchise offer, or guaranteed business opportunity.

We do not guarantee:

  • Approval, funding, a mortgage, credit availability, a particular amount, rate, payment, term, fee, product, timeline, or closing.
  • Acceptance into a loan broker, referral, partner, training, or business-opportunity program.
  • Commissions, earnings, customers, leads, funded deals, profitability, business growth, or any particular financial result.
  • That a specific partner will contact you, request additional information, provide an offer, or be able to serve your state or situation.

Any figures attributed to a network, partner, leader, testimonial, media source, or third-party website describe that source’s public statements or past experience. They are not Magnetic Funding Source results and are not a representation of what you will receive or earn.

6

Funding Review and form submissions

When you submit the guided Funding Review or another website form, you request that the information be received, organized, and routed for possible review and follow-up. The form may transmit information through Salesforce Web-to-Lead, a customer relationship management system, website infrastructure, email, analytics, or another service provider.

  • A submission is not a completed loan or mortgage application unless an authorized independent provider expressly tells you otherwise.
  • A submission does not obligate you to accept a product, sign an agreement, pay a fee, or enter a broker or partner relationship.
  • A partner may require a separate application, identity verification, credit authorization, supporting documents, disclosures, consent, or agreement.
  • Submitting duplicate or incomplete information may delay, prevent, or complicate review.
Protect sensitive information: Do not send Social Security numbers, passwords, complete bank credentials, full payment-card numbers, tax returns, or unrequested financial documents through ordinary email or a general contact form. Use a secure method supplied by an authorized provider when sensitive documents are specifically requested.

Pathway-specific terms

Pathway What this website does What controls an actual transaction
Business Funding Collects preliminary business and funding information and routes the request for possible review. The independent provider’s application, underwriting, disclosures, offer, agreement, and applicable law.
Self-Employed Mortgage Collects preliminary property, self-employment, income, timing, and contact information for possible mortgage-related follow-up. The licensed or authorized provider’s application, Loan Estimate or other required disclosures, underwriting, approval, and closing documents.
Loan Broker or Funding Partner Collects interest, experience, location, and potential-referral information and may route it to an independent network or partner. The network’s disclosure documents, qualification process, training or service terms, compensation plan, refund policy, agreement, and applicable law.

Business-purpose funding

Some business-purpose financing products are different from consumer loans and may involve distinct pricing, repayment structures, disclosures, security interests, guarantees, or collection rights. Carefully review all partner documents and seek independent professional advice before accepting any product.

Mortgage inquiries

Mortgage eligibility, rates, payments, property requirements, licensing, appraisals, insurance, taxes, closing costs, and approval are determined by the independent provider and applicable law. Website examples or program descriptions are general information and should not be treated as a current quote or guaranteed qualification.

Broker and partner opportunities

A broker, referral, training, or funding-partner opportunity is separate from requesting financing. Nothing on this site guarantees employment, independent-contractor status, commissions, a protected territory, customers, leads, funded transactions, profitability, or business success. Review all required disclosure documents and agreements before paying money or making a commitment.

8

Communications and electronic consent

By voluntarily providing contact information and submitting an inquiry, you request communications reasonably related to that inquiry. Depending on the information provided and the partner involved, follow-up may occur by email, telephone, voicemail, or another method described near the form.

Any consent to receive marketing calls or text messages is governed by the specific consent language presented at the time of collection, not by these Terms alone. Where required by law, marketing consent is obtained separately and is not a condition of receiving a credit decision or purchasing a service. You may ask a sender to stop future marketing communications using the method provided in the communication.

Electronic communications may not be secure or error-free. You are responsible for maintaining access to the email address and phone number you provide and for reviewing communications from independent providers. Carrier, data, or messaging charges may apply based on your service plan.

9

Your information and responsibilities

You agree to provide information that is accurate, current, complete, and lawfully supplied. You may not impersonate another person, submit information without authorization, intentionally misstate financial or business facts, or use the website to commit fraud or evade legal obligations.

You are responsible for:

  • Reviewing all documents, disclosures, rates, fees, terms, conditions, and obligations presented by an independent provider.
  • Confirming the identity, licensing, authority, and suitability of any party before providing sensitive information or entering a transaction.
  • Seeking legal, tax, accounting, financial, insurance, mortgage, or other professional advice when appropriate.
  • Making your own decision about whether a product, service, opportunity, or relationship is suitable.
10

Privacy and information handling

Our collection and handling of personal information are described in the Privacy Policy. By submitting information, you acknowledge that it may be processed by website, CRM, email, analytics, security, Salesforce Web-to-Lead, and communication providers and may be routed to an independent partner appropriate to the pathway selected.

Independent partners may provide their own privacy notices and may process information under their own policies, agreements, and legal obligations. Review those notices before submitting additional documents or authorizing credit, identity, employment, income, property, or other verification.

11

Third-party websites, services, logos, and content

The website may contain links, forms, integrations, photographs, logos, media marks, references, or content associated with independent organizations, including public leadership websites, funding networks, media channels, technology providers, and service partners.

Magnetic Funding Source does not control third-party websites, availability, accuracy, security, accessibility, terms, privacy practices, licensing, or services. A link or logo is provided for identification or informational context and does not by itself mean that the third party endorses Magnetic Funding Source or guarantees any result.

Your use of a third-party site or service is governed by that party’s terms. If those terms conflict with these Terms concerning the third party’s product or service, the third party’s terms control that relationship.

12

No financial, legal, tax, or professional advice

Website content is general informational and marketing material. It is not legal, tax, accounting, investment, insurance, credit-repair, mortgage, real-estate, or financial advice. Nothing on the website creates a fiduciary, advisory, attorney-client, accountant-client, or similar professional relationship.

Before making a financial, property, legal, tax, or business decision, consult qualified independent professionals who understand your circumstances.

13

Intellectual property

The Magnetic Funding Source website, design, text, graphics, code, structure, and original content are owned by or licensed to Magnetic Funding Source and are protected by applicable intellectual-property laws. You receive a limited, revocable, nonexclusive right to access and use the website for lawful personal or internal business purposes.

You may not copy, reproduce, republish, sell, distribute, create derivative works from, frame, mirror, reverse engineer, or commercially exploit website content without prior written permission, except where applicable law permits otherwise.

Third-party names, logos, photographs, program names, trademarks, and media marks remain the property of their respective owners. Their appearance on this site does not transfer ownership or imply endorsement.

14

Prohibited use

You may not use the website to:

  • Violate law, regulation, court order, contract, intellectual-property right, privacy right, or another person’s rights.
  • Submit false, fraudulent, misleading, unauthorized, abusive, discriminatory, defamatory, or unlawful content.
  • Introduce malware, interfere with security, overload systems, bypass access controls, probe vulnerabilities, or disrupt website operation.
  • Use bots, scrapers, automated submissions, harvesting tools, or bulk extraction without written authorization.
  • Impersonate a person or organization, misrepresent an affiliation, or use another person’s information without permission.
  • Send spam, manipulate tracking, misuse partner information, or use the website to facilitate unlawful lending, fraud, identity theft, or deceptive business practices.

We may restrict access, block submissions, preserve records, or cooperate with appropriate parties when we reasonably believe the website is being misused.

15

Website disclaimers

To the maximum extent permitted by law, the website and its content are provided on an “as is” and “as available” basis. We do not warrant that the website will always be uninterrupted, secure, error-free, current, complete, or compatible with every device or browser.

We make no warranty regarding the accuracy or availability of third-party content, public biographical information, partner programs, funding options, mortgage products, broker opportunities, reported network figures, media references, external images, or linked websites. Program information can change without notice.

Some jurisdictions do not allow certain warranty exclusions. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

16

Limitation of liability

To the maximum extent permitted by law, Magnetic Funding Source and its owners, officers, employees, contractors, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits or revenue; lost business opportunities; lost data; reputational harm; or costs arising from reliance on website content, interruption of service, a partner decision, a declined request, a delayed closing, or a third-party act or omission.

Magnetic Funding Source is not responsible for independent partner underwriting, credit decisions, rates, fees, disclosures, licensing, communications, data practices, contracts, service quality, compensation, training, lead quality, closings, or performance.

Nothing in these Terms limits liability for fraud, willful misconduct, personal injury caused by negligence, or another liability that cannot legally be limited. Your rights may vary by jurisdiction.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Magnetic Funding Source from third-party claims, losses, or reasonable costs arising from your unlawful misuse of the website, material violation of these Terms, fraudulent submission, or infringement of another person’s rights. This provision does not require indemnification for Magnetic Funding Source’s own unlawful conduct.

17

Governing law and disputes

To the extent permitted by applicable law, these Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any court proceeding arising solely from use of the Magnetic Funding Source website or these Terms must be brought in a state or federal court with jurisdiction in or serving Duval County, Florida, unless applicable law requires another location.

Before filing a non-urgent claim, you and Magnetic Funding Source agree to make a good-faith effort to resolve the issue informally by written notice describing the dispute and requested resolution. This paragraph does not prevent either party from seeking immediate injunctive relief, filing a regulatory complaint, or using another remedy that cannot lawfully be restricted.

18

Suspension, changes, and general provisions

Suspension or termination

We may suspend, restrict, or terminate access to all or part of the website when reasonably necessary for security, maintenance, legal compliance, fraud prevention, misuse, or business changes. We may also modify or discontinue website features or pathways without guaranteeing continued availability.

Changes to these Terms

We may update these Terms to reflect changes in the website, services, partner relationships, technology, or legal requirements. Updated Terms will be posted with a revised “Last updated” date. Your continued use after an update constitutes acceptance to the extent permitted by law.

Severability and waiver

If a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

Assignment and entire agreement

You may not assign your rights under these Terms without written permission. We may assign these Terms in connection with a merger, sale, restructuring, financing, or transfer of the website or business. These Terms and the Privacy Policy form the complete website-use agreement between you and Magnetic Funding Source, but separate partner documents govern partner products, services, and opportunities.
